Terms and Agreement

Alexis Baxter Foundation 501C3 ACKNOWLEDGMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT INTRODUCTION. Please read this entire Acknowledgment and Assumption of Risks & Release and Indemnity Agreement (hereafter “Document”) carefully before signing. For Glo girls under 18 years of age (hereafter sometimes “minor” or “child”), one of the camper’s parents or legal guardians, or both, if available (hereafter collectively “parent/s”) must sign. In consideration of the services of  the Alexis Baxter Foundation and its owners, officers, directors, employees, agents, representatives, volunteers and all persons or entities affiliated with it, and its independent contractors, (individually and collectively referred to in this Document as “ABF”), in allowing me/my child to participate, I (parent/s of a minor glo girl) acknowledge and agree as follows:

ACTIVITIES, RISKS AND ACKNOWLEDGMENT AND ASSUMPTION OF RISKS Participating (whether attending, observing or actively participating) in ABF educational, instructional, recreation and/or adventure activities includes risks. Activities take place in Philadelphia, either on or off camp premises, and may be conducted or led by ABF staff, contractors or others. Activities may include, but are not limited to: shampooing, coloring, cutting, acrylic nails, facials and hair braiding; camp craft, use of any equipment, facilities or otherwise (collectively referred to in this Document as “activities”). Activities may be scheduled or unscheduled, supervised and include activities undertaken during Glo Girl free and/or independent time. I acknowledge that the inherent and other risks, hazards and dangers (collectively referred to in this Document as “risks”) of these activities can cause injury, damage, death or other loss to Glo Girl or others. Parent/s give permission for their child to participate in all ABF activities and agree to discuss the nature of these activities and risks with their child. Not all risks are known or can be anticipated. The following describes some, but not all of those risks:Risks present in salon atmosphere. These risks include burning oneself from using hot irons and blow dryers. Cutting oneself when using scissors to cut hair.  Allergic reaction to chemicals, etc.Personal health and participation risks. Camper’s mental, physical or emotional condition (including use of prescription or non-prescription drugs), disclosed or undisclosed, known or unknown, combined with participation in these activities includes risks. Although ABF personnel will review camper’s submitted health and medical information, ABF cannot anticipate or eliminate risks or complications posed by Glo Girl’s mental, physical (including fitness level) or emotional condition.Equipment risks. The risk that equipment used in an activity may be misused, or may break, fail or malfunction. This includes glo girls personal equipment, ABF equipment or other equipment (whether purchased borrowed or rented).Risks regarding conduct. The potential that the glo girl, or others may act carelessly or recklessly. These and other risks may result in campers: burns; illnesses; infections; cuts or wounds or other injury, damage, death or loss.

I (parent/s of a camper) acknowledge and agree: to review and/or complete all required forms or materials received, abide by the terms of those documents, and obey all ABF rules and other policies;• ABF representatives are available should I have further questions about these activities or the associated risks; to disclose to ABF representatives any mental, physical or emotional condition/s or limitation/s which might affect camper’s ability to participate, and represent that the glo girl is fully capable of participating without causing harm to herself or others;• the information provided above is not complete, other unknown or unanticipated activities, risks, and outcomes may exist, and ABF cannot assure glo girl’s safety or eliminate any of these risks;•glo girl is voluntarily participating with knowledge of the risks. Therefore, parent/s assumes and accepts full responsibility for glo girl, for the inherent and other risks (known and unknown, described above or otherwise) of these activities and for any injury, damage, death or other loss suffered by camper (and parent/s), resulting from those risks, including the risk of glo girls own negligence or other misconduct.

RELEASE AND INDEMNITY

Agreement Please read carefully. This Release and Indemnity Agreement contains a surrender of certain legal rights. I (parent/s for themselves and for and on behalf of their participating minor child) agree as follows:1) to release and agree not to sue Alexis Baxter Foundation., with respect to any and all claims, liabilities, suits or expenses (including attorneys’ fees and costs) (hereafter collectively “claim” or “claim/s”) for any injury, damage, death or other loss in any way connected with my child’s enrollment or participation in these activities, including use of any equipment, facilities or premises. I understand I agree here to waive all claims I or my child may have against ABF, bind my/my child’s estate and any family member/heir/other party bringing claims and agree that neither I, my child, nor anyone acting on my or my child’s behalf, will make a claim against ABF as a result of any injury, damage, death or other loss suffered by me or my child;2) to defend and indemnify ABF with respect to any and all claims:(a) brought by or on behalf of me, my child or spouse or my child’s other family member/s, heir/s or estate for any injury, damage, death or other loss in any way connected with my child’s enrollment or participation in these activities, including use of any equipment, facilities or premises; and/or(b) brought by another camper or any other person for any injury, damage, death or other loss to the extent caused by my/my child’s conduct in the course of participating in these activities, including use of any equipment, facilities or premises.This Release and Indemnity Agreement includes claims of or resulting from ABF’s negligence, and includes claims for personal injury or wrongful death (including claim/s related to emergency, medical, drug and/or health issues, response, assessment or treatment), property damage, loss of consortium, breach of contract or any other claim.

 

OTHER PROVISIONSI (parent/s of a minor camper) agree that Pennsylvania law (without regard to “conflict of laws” rules or “choice of law” principles) governs this Document.I agree that any dispute arising under, out of, in connection with, or in relation to: 1) this Application and Terms of Agreement and Acknowledgement and Assumption of Risks and Release and Indemnity Agreement; 2) my child’s participation in Camp ABF; or 3) with ABF in any respect shall be determined and settled by arbitration . Any award rendered shall be final and conclusive upon the parties, and a judgment thereon may be entered in the highest court of the forum, state or federal, having jurisdiction. I further agree that as a condition precedent to commencing any arbitration proceeding, mandatory participation in mediation before a mediator shall be required. This Agreement, together with any other instruments or agreements referred to herein, constitutes the entire agreement among camper, parent/s and ABF with respect to the subject matter hereof, and there are no other representations, warranties or agreements, except as herein provided.I further agree that should any clause, sentence, paragraph or other part of this Document be finally adjudged by any court of competent jurisdiction to be unconstitutional, invalid or in any way unenforceable, such adjudication shall not affect, impair, invalidate or nullify the Document, nor shall it serve as the basis for the rescission, avoidance or annulment of the Document, but shall affect only the clause, sentence, paragraph or other part so adjudged.Parents/s of a minor glo girl agree:I have carefully read, understand and voluntarily sign this Document and acknowledge that it shall be effective and legally binding upon me, my spouse, participating minor child and other children, and my/my child’s other family members, heirs, executors, representatives, subrogors, assigns and estate. This Agreement, together with any other instruments or agreements referred to herein, and any dispute that may arise hereunder or thereunder, shall be governed by Pennsylvania law. One or both parent/s of a minor camper must complete the information and sign below.

 

TERMS OF AGREEMENT

 

Introduction:It is important that all glo girls, parent/s or legal guardian/s (collectively “parent/s”), and staff members have a full understanding of, and be in agreement with, the overall Alexis Baxter Foundation. (“ABF”) philosophy, ideals, goals, and policies. The Alexis Baxter Foundation Glo Girl Beauty Camp program is designed to be a positive and constructive group experience. Campers are expected to participate enthusiastically in all camp activities.Our Glo Girl Campers:Camp programs are open to all girls of high character. ABF does not discriminate in its admissions policies on the basis of race, color, gender, religion, national or ethnic origin, age or disability. ABF is not, however, a treatment center, and ABF staff are not trained to deal with campers who have severe mental, physical or emotional difficulties. We do reserve the right to refuse admission to our programs, in appropriate cases. Application Procedure: Applications are accepted until all space is filled. After that, we include applications on a numerical waiting list. Names cannot be placed on the waiting list until we receive both the application and required deposit. If we cannot confirm your registration, we will refund the entire deposit. After we have confirmed your registration, you will receive an email with enrollment confirmation documents. In addition, you will receive an email with information about camper forms. These forms contain important information associated with the camper’s camp experience, so please read and complete these forms carefully. All forms must be completed and signed by parent/Final acceptance and participation in the camp session is contingent on our receipt and review of all completed and signed forms. Tuition and Terms of Payment: The tuition fee includes  course and well as meals. All expenses are included except personal expenses (see below). Personal expenditures: Personal expenditures such as travel arrangements between home and camp are not part of the camp tuition fee. Cancellation, Return and Insurance:ABF reserves the right to dismiss any camper from the program that staff believes, in their discretion, presents a safety concern or medical risk, is disruptive, or otherwise conducts herself in a manner detrimental to the camp community.• I acknowledge that if I or my child is dismissed or departs from camp for any reason, no refunds can be granted. Parents are responsible for all costs of early departure whether for medical reasons, dismissal, personal emergencies or otherwise. These costs include but are not limited to medical and/or airlift evacuation and costs.

Arrival/Dismissal: Camp begins 9am promptly. Doors open 8:30am. Please make arrangements for camper to arrive on time to alleviate disruption of other campers and missing valuable activities.  Please make proper arrangements for pickup of campers at 3pm. 

 

 

Camp Rules and Camper Behavior

  1. There shall be no smoking or use of smokeless tobacco; no drinking of alcoholic beverages; no use of marijuana or illegal drugs; and no unauthorized use of prescription drugs or other controlled substances or narcotics or related drug equipment either on or off camp property.2. The camper term is 2 days (fri & sat), and parent/s and campers should make no “deals” regarding the time of departure, after camp begins. The Camp ABF program has a carefully planned beginning, middle and end. Campers must complete the entire term.3. Parent/s and campers may communicate via phone according to a pre-determined schedule worked out on the first day of camp. Medical Treatment and Consent:I authorize ABF staff, representatives, contractors or other medical personnel to obtain or provide medical care for me or my child, to transport my child to a medical facility and to provide treatment (including hospitalization, medications, anesthesia, surgery) they consider necessary for my child’s health. I agree to the release (to or by ABF) of any records necessary for treatment, referral, billing or insurance purposes. I agree to pay all costs associated with any medical care and/or transportation, including medical and/or airlift evacuation and related expenses. Lost, Stolen or Damaged Property: ABF is not responsible for a camper’s lost, stolen or damaged personal belongings. In addition, campers and their parent/s will be held responsible for damage to or loss of ABF property or equipment.

  2. Photo and Promotional Release:I authorize ABF or its designees to photograph, film, record and/or otherwise capture the name, image, voice, written or spoken statement (including quotations from conversations or correspondence) photograph and/or visual likeness of me or my child (collectively “images”), for use in any media throughout the world, in perpetuity, including for sale, reproduction or display on the worldwide web (including websites or YouTube), and in catalogues, displays, motion pictures, audio and/or video recordings or other form for any informational or promotional purpose for ABF, without compensation to parent/s or my child. ABF owns all ownership/copyright rights in the images and I waive any privacy, inspection or approval rights.

  3. Parental Authority:I certify and represent that I am the child’s legally authorized parent or guardian, and that I have the legal authority to permit my child to participate in all ABF activities, and to execute this and all other required documents for myself and for and on behalf of my participating child. To the extent necessary, I agree that I have obtained any and all other pertinent consents or authorities (including any required by a court decree or order; for example, a divorce decree, custody order or joint parenting plan). I fully understand and agree that if my child’s other parent (or anyone else) challenges my authority: a) the child will be dismissed from Camp ABF and any ABF activities, without a refund, if the parents or other parties involved cannot reach agreement, and, b) I will fully defend and indemnify ABF per the terms of the ABF Acknowledgment and Assumption of Risks & Release and Indemnity Agreement or otherwise, with respect to any claims made by the other parent or any person, including payment of any costs or attorneys’ fees expended by ABF to resolve a dispute.
